Pongobyte Computers Payment Plan Terms and Conditions
(the Payment Plan Terms and Conditions)
- General
1.1. If you place a order for Good(s) with deferred payment, the terms and conditions set out these Payment Plan Terms and Conditions and the Pongobyte Computer sales terms and conditions (available at https://pongobyte.com.au/terms-conditions/) (the Sales Terms and Conditions) will both apply to that order.
1.2. To the extent that there is any inconsistency between these Payment Plan Terms and Conditions and the Sales Terms and Conditions, the terms and conditions set out in Payment Plan Terms and Conditions shall prevail. Terms not defined in these Payment Plan Terms and Conditions, take the meanings given to them in the Sales Terms and Conditions.
1.3. References to “Pongobyte Computers”, “us”, “our” or “we” in these Payment Plan Terms and Conditions are references to Pongobyte Computers (ABN 37 557 669 574).
- Payments
2.1. The order form will state the Price, the Delivery Fee (if applicable), the deposit amount, the dates and amounts of the instalment payments (the Payment Schedule) and the Termination Fee.
2.2. We will charge you, and you agree to pay, each instalment amount (Instalment Amount) by the payment date specified in the Payment Schedule.
2.3. All fees and charges identified in these Payment Plan Terms and Conditions and all prices for the Goods include GST where applicable.
2.4. You may pay the Instalment Amounts due on each of the payment dates specified in the Payment Schedule for an accepted order by Paypal or direct funds transfer. We apply a surcharge of 2.5% of the Instalment Amount for payments made by Paypal or by debit or credit card.
2.5. You will be responsible for making the payments on the relevant instalment payment dates.
2.6. The Goods will only be delivered once we have received the final Instalment Amount.
- Cancellation
Cancellation by Pongobyte Computers
3.1. We may cancel any order made under these Payment Plan Terms and Conditions, without any liability to you for that cancellation, at any time if:
3.1.1. you have breached a term of these Payment Plan Terms and Conditions or the Sales Terms and Conditions;
3.1.2. Pongobyte Computers is no longer engaged in trade or commerce; or 3.1.3. the Good(s) in your order are no longer available.
3.2. If we cancel your order in accordance with clause 3.1, we will refund you all the amounts paid by you under the order and these Payment Plan Terms and Conditions, minus, in the case of clause 3.1.1, the Termination Fee.
Cancellation by you
3.3. You may cancel an order made under these Payment Plan Terms and Conditions at any time before delivery of the Goods. We will refund all amounts you have paid minus the Termination Fee.
Termination Fee means for custom made or specially ordered Goods, once 50% of the Instalment Amounts have been paid, a fee of 20% of the sum of the Price and Delivery Fee.
3.4. When any refunds made following a cancellation are received will depend upon our and your financial institution’s processing times.
